Introduction

Mohawk Limited ('we’, ‘our’ or ‘us’) is committed to respecting your privacy.

We will comply with our obligations under the Privacy Act 2020 and any other applicable privacy laws. We have also put in place this privacy policy so you can understand how we collect, store, use, disclose and retain personal information.

Except where we specifically stated otherwise this privacy policy applies to all personal information we collect, including information we collect via or in connection with our website, applications, social media pages and services (our 'Services').

‘Personal information’ refers to identifiable information about you, like your name, email, address, telephone number, support queries and so on. If you cannot be identified (for example, when information has been aggregated and anonymised) then this privacy policy will not apply.

By providing us with your personal information and using our Services, you consent to the collection, storage, use and disclosure of your personal information in accordance with this privacy. 

We may amend this privacy policy from time to time, and will notify you of any changes by posting an updated version on our website. It is your responsibility to check this privacy policy periodically for amendments.

How we collect your information

The ways we collect personal information can be broadly categorised as follows:

  • Information you provide to us directly: When you contact or communicate with us or visit or use our Services you may provide or we might ask you to provide personal information. If you do not want to provide us with personal information, you can choose not to, but it may mean that some of our Services will not be available to you.

  • Information we collect automatically: We may collect some information about you automatically when you visit or use our Services. Some of this information is collected using cookies and similar tracking technologies. We use cookies and/or other tracking technologies to distinguish you from other users of our Services. We also use cookies to remember your preferences. This information is useful for us as it helps us get a better understanding of how you are using our Services so that we can continue to optimise our Services.

  • Information we get from third parties: We may collect personal information about you from other sources, such as publicly available materials or third parties (e.g. your employer or a business which supplies or purchases products or services to or from you or your employer).

Information we hold on behalf of a third party

Sometimes we may hold your information on behalf of a third party and not for our own purposes. This might be where, for example, one of our customers engages us to process data for them in connection to a cloud services arrangement.

Where we do this, this privacy policy (other than this section) will not apply. You should contact the third party if you have any questions or requests about your information (including if you want to request access to or a correction of your information) or the third party's privacy policies and practices.

How we use your information

We do not sell, trade or rent your personal information to others. First and foremost, we use your information to operate and provide our Services and to manage our relationship with you. We may also use your personal information for other purposes, which may include the following:

  • To communicate with you: This may include:

·        providing you with information you have requested from us or information we are required to send to you;

·        operational communications, like changes to our Services, security updates, or assistance with using our Services;

·        subject to complying with applicable anti-spam laws, marketing communications or targeted advertising about any product or service we think you might be interested in; or

·        asking you for feedback.

  • To support you: This may include assisting with the resolution of technical support issues or other issues relating to the Services, whether by email or otherwise.

  • To enhance and develop our Services: For example, tracking and monitoring your use of our Services so we can optimise your user experience and provide you with more efficient tools.

  • To protect: So that we can detect and prevent any fraudulent or malicious activity, and make sure that everyone is using our Services fairly and in accordance with our applicable terms of use.

  • To analyse, aggregate and report: We may use information we collect about you and others to produce aggregated and anonymised analytics and reports, which we may share publicly or with third parties.

How we can share your information

There will be times when we need to share your information with third parties. We will only disclose your information to:

  • third party service providers and partners who assist and enable us to use the information in accordance with the privacy policy. For example, to support the delivery of Services to you or to manage our relationship with you;

  • regulators, law enforcement bodies, government agencies, Courts or other third parties where we think it is necessary to comply with applicable laws or regulations, or to exercise, establish or defend our legal rights. Where possible and appropriate, we will notify you of this type of disclosure;

  • an actual or potential buyer (and its agents and advisors) in connection with an actual or proposed purchase, merger or acquisition of any part of our business; or

  • other people where we have your consent or the disclosure is permitted under the Privacy Act 2020 or other applicable privacy laws.

International data transfers

When we share information, it may be transferred to, and processed in, countries other than New Zealand. These countries may have laws different to New Zealand. Where we disclose personal information to a third party in another country, we will either obtain your express authorisation to do this or put safeguards in place to ensure your personal information remains protected. We may do this by ensuring the third party is located in a country whose privacy laws provide comparable safeguards or by entering into appropriate contract terms.

Security

We are committed to protecting the security of your information and we take all reasonable precautions to protect it from loss, unauthorised or accidental access, disclosure, alteration, destruction, other misuse and actions which prevent us from accessing your information on a temporary or permanent basis (each event being a 'Privacy Breach').

We use industry standard (or better) administrative, physical and technical protections to safeguard the security, privacy, confidentiality and integrity of your information.

If your information is subject to a Privacy Breach that is likely to cause you serious harm, we will notify you and the Privacy Commissioner or other applicable regulator in accordance with our legal obligations. 

Retention

The length of time we keep your personal information depends on what it is and whether we have an ongoing business need to retain it (for example, to provide you with a Service you have requested or to comply with applicable legal, tax or accounting requirements).

We will retain your personal information for as long as we have a relationship with you and for a period of time afterwards where we have an ongoing business need to retain it, in accordance with our data retention policies and practices. Following that period, we will make sure it is deleted or anonymised.

Your rights

It is your personal information and you have certain rights relating to it.

We are committed to complying with the Unsolicited Electronic Messages Act 2007 and any other applicable anti-spam legislation. You can unsubscribe from our commercial electronic communications at any time by following the unsubscribe process within the communication. Once you have unsubscribed, you will be removed from the corresponding marketing list as soon as is reasonably practicable.

You also have rights to know what personal information we hold about you, and to request that it be corrected. You can exercise these rights at any time by making a request to our Privacy Officer whose details are provided below. We will review your request as soon as reasonably practicable. If we are unable to grant your request, we will give you reasons for this decision.

We will respond as quickly as possible (our target response is 20 working days). If you remain dissatisfied, you can make a formal complaint with the Office of the Privacy Commissioner in New Zealand or other applicable regulator.
